
Criminal traffic offence case
Our Law Firm undertook the defence of a defendant who was facing a criminal charge for parking a vehicle in a parking space designated for persons with disabilities at the New General Hospital of Limassol.
The Prosecution relied on the presumption of liability of the vehicle’s owner, without having direct evidence as to the person who was driving or had parked the vehicle at the material time. Our Law Firm rebutted this presumption by establishing, through coherent, credible and fully substantiated evidence, that the vehicle was being driven by a third person, the holder of a valid disability card, who had attended the Hospital for scheduled medical examinations.
During the hearing, crucial documentary evidence was adduced, including medical documents dated the same day and the driver’s disability card, while it was demonstrated that the card’s lack of visibility at the time of inspection was due to its accidental displacement inside the vehicle.
The Court fully accepted the position of our Law Firm, found that the defendant did not have control of the vehicle at the material time and concluded in her complete acquittal and discharge from all charges.
