Power of Attorney in Cyprus

A Power of Attorney (POA) is a legal document that allows a person (the grantor) to appoint another individual (the agent or attorney) to manage their affairs and make decisions on their behalf. Under Cypriot law, a POA must be signed and officially notarised to be valid.

Cyprus recognises two main types of power of attorney:

  • General POA – grants broad powers to act on the grantor’s behalf across multiple areas.

  • Special POA – limits the agent’s authority to specific tasks or a defined timeframe.

A power of attorney allows you to appoint one or more individuals to act on your behalf during your lifetime. In Cyprus, a POA is typically executed as a notarised statement rather than a simple letter.

  • Grantor (principal): the person giving authority

  • Agent (attorney/grantee): the person receiving authority

General vs. Special POA:

  • General POA: grants the attorney broad authority to act on your behalf in matters such as finances, company formation, contract signing, and more.

  • Special POA: grants authority for specific actions or a limited number of tasks. It cannot be used beyond the intended purpose.

☑️ How to Create a Power of Attorney

The POA must be:

  • Signed by the grantor

  • Certified and stamped by a notary public (certifying officer)

 

Requirements:

  • Both grantor and attorney must be at least 18 years old and legally competent

  • No professional qualifications are needed for an attorney

 

Essential contents of a POA:

  1. Date and title of the document

  2. Full details of the grantor and attorney (name, date/place of birth, residence, passport information)

  3. Description of rights and powers granted

  4. Expiry date (if applicable)

  5. Signature of the grantor

 

Foreign citizens can grant a POA in the same way as Cypriot citizens, using a valid passport to verify identity and signature.

📄 Signing a POA from Abroad

It is possible to execute a POA outside Cyprus. The procedure typically involves:

  1. Preparing the document

  2. Visiting the Cyprus consulate with a valid passport

  3. Signing and legalising the document

  4. Having the POA certified

  5. Sending the certified POA to Cyprus

The cost ranges from €100 to €200.

  • Special POA: €2

💠 Common Uses of a Power of Attorney

  • Company formation: Authorise a lawyer to sign documents and register a company on your behalf.

  • Company meetings: Authorise someone to attend and vote at shareholder or board meetings. A new POA is usually required for each meeting.

  • Real estate transactions: Authorise a lawyer or agent to sign sales, rental contracts, or appear before the Department of Lands and Surveys for registration and transfer.

  • Child travel consent: Notarised consent forms are required for a child travelling with one or both parents.

  • Inheritance and succession: No POA is valid after death. Executors are appointed via a will and act under court-issued letters of probate.

​✔️ Where to Certify a Power of Attorney

A POA must be certified before a certifying officer (notary public).

  • Officers are appointed by the Ministry of the Interior

  • They verify signatures and identities but do not check the content of the document

  • They maintain a seal approved by the Ministry

 

Verification requires that the person is either personally known to the officer, known to two personal references, or presents a valid passport/ID.

✖️ Cancelling a Power of Attorney

A POA can be revoked in the following situations:

  • Completion of the specified tasks

  • Death of the grantor or agent

  • Mental incapacity of the grantor or agent

  • Revocation by the grantor (all interested parties should be notified)

  • Disclaimer by the agent (a formal declaration similar to the original POA)
